Terms and conditions

These Terms and Conditions ("Agreement") govern your use of our services, including but not limited to the Higgs Games mobile application (the "App"). By accessing or using the App, you agree to be bound by these terms. If you do not agree with any part of this Agreement, please do not access or use the App.

1. Definitions
   • "Higgs Games" means the company that operates the App.
   • "User" means any individual who uses or accesses the App.
   • "Content" means all materials, information, and data accessed or provided through the App.
2. License to Use

   We grant you a non-exclusive license to use the App for personal, non-commercial purposes only. This Agreement does not transfer ownership of the App or its Content.

3. User Conduct

   You must comply with these Terms and Conditions and all applicable laws when using the App. You shall not:

   • Use the App in any manner that could damage, disable, overburden, or impair the server or network;
   • Attempt to gain unauthorized access to other accounts or systems through the App;
   • Upload or transmit any Content that is unlawful, threatening, defamatory, obscene, indecent, or otherwise objectionable; or
   • Engage in any activity that constitutes a violation of these Terms and Conditions.
4. Content Ownership

   We retain ownership of all Content provided through the App. You agree not to reproduce, modify, distribute, transmit, reuse, or create derivative works from such Content without our prior written permission.

5. Representations and Warranties

   You represent and warrant that:

   • Your use of the App will comply with these Terms and Conditions;
   • You will provide accurate and complete information when accessing or using the App; and
   • You have the necessary authority to enter into this Agreement.
6. Limitation of Liability

   We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use of the App, including but not limited to:

   • Loss of data;
   • Business interruption; or
   • Personal injury.
7. Indemnification

   You agree to indemnify and hold harmless us against all claims, demands, losses, costs, expenses, or liabilities that arise from your use of the App or breach of these Terms and Conditions.

8. Disclaimers

   The App is provided on an "as-is" and "as-available" basis. We make no representations or warranties regarding its accuracy, completeness, reliability, performance, timeliness, or suitability for any purpose.

9. Changes to Agreement

   We reserve the right to modify these Terms and Conditions at any time without notice. By continuing to access or use the App after such modifications are made, you agree to be bound by the revised terms.

10. Termination

    Your license to use the App will terminate immediately upon your breach of these Terms and Conditions. Upon termination, you must cease all use of the App and destroy any Content obtained through it.

11. Governing Law and Jurisdiction

    These Terms and Conditions shall be governed by and construed in accordance with the law. Any disputes arising out of or related to this Agreement will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Entire Agreement

    This Agreement constitutes the entire understanding between us regarding your use of the App, superseding all prior agreements and understandings.

By accessing or using the App, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
